Can Americans buy property in Cabo San Lucas?

Yes. Americans, Canadians, and other foreign buyers can legally own beachfront property in Cabo San Lucas through a Fideicomiso, a Mexican bank trust that grants the buyer virtually all rights of ownership, including the ability to sell, lease, renovate, and pass the property to heirs. A Fideicomiso is required because the property sits inside Mexico's "restricted zone" (within 50 km of the coast).

How the Fideicomiso process works

  1. You make an offer through a licensed Mexican real estate agent.
  2. A Mexican bank acts as trustee and holds the deed on your behalf, you remain the beneficial owner.
  3. The trust runs 50 years and is fully renewable, transferable, and inheritable.
  4. Closing typically takes 30–60 days. Setup costs run approximately 1%–2% of purchase price; annual trust fees are around $500–$700 USD.

What kind of rental income can a Cabo condo earn?

Rental income in Cabo is season-dependent. Studios at Terrasol typically rent from $162/night; 3-bedroom oceanfronts from $540/night. High season runs November through April. Many owners offset a significant portion of their ownership costs through vacation rental income. Serious buyers can request real occupancy and performance data from existing Terrasol units.
